Welcome to Super! These Terms of Service ("Terms") govern your access to and use of Super ("Service"), a social media management app on the Farcaster protocol. Our Service allows you to manage, schedule, and analyze your social media content across various platforms. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. General

1.1. These Terms constitute a legally binding agreement between you ("User") and Supercast, LLC ("Company").

1.2. The Company reserves the right to modify these Terms at any time. Your continued use of the Service after any such modifications constitutes your acceptance of the new Terms.

2. Access and Use of the Service

2.1. The Service is offered on a subscription basis, available as monthly and yearly plans.

2.2. By subscribing to the Service, you gain access to the app for the duration of your subscription period.

2.3. You are responsible for maintaining the confidentiality of your account and login details. You agree to accept responsibility for all activities that occur under your account.

2.4. You agree to use the Service in compliance with all applicable laws and regulations, including those related to social media use and data privacy.

3. Subscription and Payment

3.1. Subscription fees are billed on a recurring basis, either monthly or yearly, depending on the plan you select.

3.2. All payments are processed through Stripe. You must provide accurate and complete payment information and update it promptly in the event of any changes.

3.3. The Company reserves the right to change subscription fees upon reasonable notice. Any changes will be communicated to you and will apply to the next billing cycle.

4. Cancellation and Termination

4.1. You are solely responsible for canceling your subscription. Cancellation can be done through the website. There are no other methods available for cancellation.

4.2. No refunds will be provided for any subscriptions. You pay solely for access to the app, and all sales are final.

4.3. The Company reserves the right to terminate your account at any moment if you abuse the Service, violate these Terms, or engage in any activity that may harm the Company or other users.

5.2. Additional support can be obtained through our Telegram group chat for members.

6. Use at Your Own Risk

6.1. Your use of the Service is at your own risk. The Company does not bear any responsibility for any data lost or other damages incurred through the use of the Service.

6.2. The Company is not responsible for any damages, including data loss, resulting from a hacker attack.

6.3. While we strive to maintain the highest levels of service availability, we do not guarantee uninterrupted access to the Service and are not liable for any downtime or data loss.

7. Limitation of Liability

7.1. To the maximum extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) unauthorized access, use, or alteration of your transmissions or content; or (d) any changes to third-party social media platforms that may affect the functionality of our Service.

8. Governing Law

8.1. These Terms shall be governed and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

9. Entire Agreement

9.1. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the use of the Service and supersede all prior agreements between you and the Company.

10. Prohibited Activities

10.1. Users are prohibited from:

  • Scraping, data mining, or otherwise extracting data from the Service
  • Posting illegal, offensive, or harmful content
  • Spamming or engaging in any abusive behavior
  • Abusing the API or attempting to gain unauthorized access to the Service
  • Violating the terms of service of any third-party social media platforms connected to our Service
  • Using the Service to distribute malware or engage in any malicious activities

Any such activities will result in immediate termination of your account.

11. Community Guidelines

11.1. By agreeing to these Terms of Service, you are agreeing to the Community Guidelines. These include:

  • Zero tolerance for abusive users or harassment of others
  • Zero tolerance for hate speech
  • No posting of illegal content
  • No incitement to violence
  • No spam or misleading content
  • No misleading impersonation
  • Respect for intellectual property rights

12.1. The Service and its original content, features, and functionality are owned by Supercast, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

12.2. You retain all rights to the content you post through our Service. By using our Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute your content solely for the purpose of providing and improving the Service.

13. Data Privacy and Security

13.1. We take data privacy and security seriously. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

13.2. You are responsible for ensuring that your use of our Service complies with all applicable data protection laws, especially when managing social media accounts for third parties.

14. Arbitration Agreement

14.1. PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR RIGHTS. Any and all disputes or claims that have arisen or may arise between you and the Company will be resolved exclusively through final and binding arbitration, rather than a court. You agree to waive the right to a trial by jury or to participate in a class action.

15. Changes to the Service

15.1. We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.
